SUPREME COURT

CLAIM FOR DAMAGES SETTLED

A compromise, at £llBB 13s 2d with costs, in a claim by Anne Elizabeth Worthington, a typist, suing by her father, Roy Tatham Worthington, a rubber worker, against the New Zealand Railways Department, was approved by Mr Justice Northcroft in the Supreme Court yesterday. Mr B. A. Barrer appeared for the plaintiff, and Mr C. S. Thomas for the defendant.

Mr Barrer said the claim had been settled for the amount stated. The girl, aged<-17, was riding her bicycle in a westerly direction past Barnett’s corner, Cathedral square, on February 29, 1952, when she was run into from behind by a Railway Road Services bus. A question was raised whether she had ridden into the side of the bus or the bus had run into her from behind. The girl seemed to have made a fairly good recovery from her injuries and was back at work. His Honour said the compromise seemed to be a sensible one and not ungenerous on the part of the defendant. The Court had no hesitation in giving its approval.
