ATTEMPTED ABORTION CHARGE
MAN REMANDED FOR SENTENCE (New Zealand Press Association) AUCKLAND, May 22. A jury in the Supreme Court at Auckland today found Bert Roland Sergeant, aged 42, a caretaker, guilty of attempting unlawfully to use an instrument on a young woman with intent to procure a miscarriage, and of unlawfully procuring an instrument, knowing it to be intended for an unlawful use. The jury failed to agree on a charge against Sergeant’s brother, Selwyn Henry Sergeant, aged 35, a labourer, of inciting Bert Roland Sergeant to commit the offence. At the request of the Crown, a charge of attempting unlawfully to use an instrument, brought against Selwyn Sergeant, was withdrawn, and replaced with the charge of inciting his brother to commit the offence. Bert Sergeant was remanded for Sentence. In the case of Selwyn Sereant, a new trial was ordered.
