A SERVICE LICENSE.
APPEAL AGAINST CANCELLATION (PRESS ASSOCIATION TBI KGR.IM.) GISBORNE, August 19. Whitfields' Motor Service proceeded against the Napier Transport Licensing Authority, in the Supreme Court to-day, claiming a writ of certiorari and prohibition. They alleged that their license for the Napier-Gisbornc road had been improperly cancelled, without due notice, and that the Licensing Authority had refused to hear argument on the points of law involved. Plaintiffs further alleged that relevant information had been suppressed by defendants. Counsel for plaintiffs applied to add the ground of bias, claiming to have discovered that Bernard Chambers held 700 shares and Mason Chambers 395 shares in the Hawke's Bay Motor Co., the former being uncle to. and the latter father of, Maurice Chambers, a member of the Licensing Authority, and that Ivan Logan, a brother of Prank Logan, chairman of the Licensing Authority, was shown as co-trustee for 2150 shares. Defendants claimed that the cancellation of the license was in order, Whitfields having failed to run the services prescribed by the license. Decision was reserved.
