Captain Leslie, master of the Malabar, was found, guilty of negligence by the Commonwealth Court of Marine Enquiry and hip certificate -was cancelled. The chairman ol the Court, Mr Laidl*w, S.M., ssid it was unfortunate that a J^eslie'9 flne record sifd his years should havf? been fqund guilty of neglect. The Court's first duty was to decide whether he should be further trusted "with the eustody of a ship, and on the evidence there was no alternative but tp cancel his certificate. Captain Leslies counsel had submitted that the two Malayan quartermasters had conspired and given false evidence againat Captain Leslie Ttfith regard to his orders on the bridge. On the other hand, the Deputy-Director of Navigation argued that Captain Leslie did no* take action soon enough to place the Malabar. in $ position of safety.
