MAGISTERIAL, TUESDAY. (Before Mr H. P. Lawry,. S.M.) DRUNKENNESS.

Arthur Francis Weston, aged 57 years, was oharged with being found drunk, and with a breach of his prohibition order. On the first charge, Weston was fined 10s, and on the second 20b. MAINTENANCE CASE. Maud Harwojd proceeded against her husband, Albert Edward Harwood, for separation, guardianship, and maintenance orders. The orders were grinted, but the guardianship order will not be in respect to -one of the children. Maintenance was fixed at 25s a week. THEFT OF MONEY. Richard Green, aged 42 years (Mr J. B. Batchelor) was charged with stealing the sum of £3 from William Angus A charge that he was an idle and disorderly persou, in that ho had insufficient lawful means of support, was withdrawn. Detective Carroll stated that Green had gone to tho last day's races of the Addington Easter meeting. When there ho had met Mr Angus, who had given him £3 to invest on one of the horses in the big race. Mr Angus had.not seen accused again. The following day Green left the Trocadero

Hotel, where he had been staying, without paying three weeks' board. William Angus stated that he had given Green £3 to invest on a horse about half an hour before the totalisator closed. Witness did not see Green on the course again. Evidence was called to prove that Green had left the Trocadero' Hotel without paying his board. The defence was that Green had accepted the money from Angus to invest on a certain horse. He had wandered round the course for a while, and ' when he went to invest the money, he was slmt out from tho totalisator.' Ho had not seen Angus on the course again, but he had every intention of repaying the money. Green was convicted and admi.tted to probation for a period of two' years.' He was ordered to refund the £3 within seven days. TWO MONTHS' GAOL. Charles Arthur Kirk (Mr J. B. Batchelor) appeared for sentence on five charges of stealing bicycles in July and August, 1925. Kirk had previously been > committed to the Supreme Court for trial on charges of stealing nine bicycles, the Magistrate reserving his decision on the summary ct arges. The Magistrate dismissed three of the charges, and convicted and 'sentenced Kirk to two months' imprisonment on each of the other charges, the sentences to be concurrent. Kirk had several t>revious convictions. CREDIT BY FRAUD Ernest Joseph Norric (Mr J. B. Batchelor) pleaded not guilty to four charges of obtaining credit from the White Diamond Taxie, Ltd., and the Rink Taxis, Ltd., thereby obtaining credit by fraud Chief-Detective Carroll stated that accused had been boarding in Colombo street, la four instances he ordered taxis. He got into the taxis and asked the drivers to take him to a certain place. When he arrived there, he told them that he either had no money, or to book the amount up to him. In one instance he had booked the amount to the account of another man. James O'Neill, taxidriver, employed by the Rink Taxis, Ltd., stated that on April 26th, about 11.30 pm.. he received a telephone message f o proceed to the end of Colombo »treet. Whan witness aarived there, accused came out and told him to drive to the Square. When- they arrived at the Square accused was told that the amount of the fare was 59 3d. Accused said that Be had better book it up, as he did not have the money. Witness had not received -he money. To Mr Batchelor, witness ,-aid that quite a number of people had standing accounts with the firm. Evidence of a simitar nature was given by three other taxidrivers The defence was that Nome had never ■been sent accounts for th 3 amounts that were owing. He was expecting money to arrive anv day, and had been nrepared to pay the accounts. Norrio was convicted on each charge, and admitted to probation for six months.

Malzard was ordered to pay tho Home Supply Co., Ltd., the sum of £l7 ss, in default 17 days' imprisonment, warrant to bo suspended as long as defendant pays 5s per week. DEPENDED CASES. Matilda Ann Emery, .greengrocer (Mr A. C. Cottrell), claimed from William Muncey, motor-drivor, tho sum of £8 6s 6d allegedly due for four weeks' rent of a cottage and for repairs to spouting and drainpipe, as in the terms of the agreement. Judgment was given for plaintiff for £6 15s 3d and costs. CLAIM UNDER AWARD. Isabel Stribbling, waitress (Mr W. J. Hunter), claimed from Catherine Blogg, restaurant proprietor (Mr W. F. Tracy) tho sum of £23 10s, being allegedly tho meal allowance at 12s per week due to her by defendant in lieu of meals supplied, under the provisions of the New Zealand Tearoom and Restaurant . Employees' award, while plaintiff was employed lay defendant as a wnitress for tho period from December 15th, 1926, to September 26th, 1927, less the sum of 10s paid by defendant on -ccount thereof After l«arinf» the evidence, the Magistrate reserved his decision
