ACTION BY SHAREHOLDER. (PBESS ASSOCIATIOX TELEOBIH.) HAMILTON, September 15. In the Supreme Court to-<lay, Fran, cis Beattie Whisker, farmer, sought to compel the New Zealand Co-operative Dairy Company, of which he is a shareholder but no longer a supplier, to resume 169 shares in the company. After hearing the evidence, Mr Justice Herdman said tho whole question rested upon the interpretation of tho legislation, which said the company may resume shares. The question was whether "may" was to be read "shall." Tho assistant-secretary of the company said that applications for resumption were considered, but it was the policy not to resume where the supply was diverted to a rival concern. Judgment will be given after counsel have submitted written argument.
