(Before Mr T. A. B. Bailey, S.M.) G. J. Martyn was brought up on re-, mand on a charge of obtaining liquor while prohibited. Sergeant Mackay said that the information relating to defendant's discharge from Pakatoa before the expiry of his last sentence was not yet to hend. Mr Van Ascli asked if the Magistrate had some intention of committing Martyn again, as he intended to address the Court on that nvatter. Mr Bailey eeid he had that in view. The case was further adjourned. % The case J. Sansom v. J.-W. Robineon, £13 Is 6d, was adjourned. Mrs E. J. McHugh sued P. H. O'Connell and Annie O'Connell for £15, value of a mare.

Mr Johnston, for plaintiff, stated a distress had been levied on plaintiff for a dressmaker's account, and the male defendant offered to secure her effects by nominally purchasing the mare for £3, a mangle for £1, and some geese for 10s. No money passed, but defendant maintained he had a receipt. Possession r>as not taken, but later plaintiff drove to Christchurch, where defendant seized the mare. He was an undischarged bankrupt and claimed, when demand was made, to have purchased the mare for the female defendant.

Evidence was given by two witnesses. For the defence, CConnell said it was not the only time he had advanced money to plaintiff when she-wanted assistance. The affair was a clear sale. To the Bench: Witness had not taken possession of the mangle or geese, although the transaction was made some months since. Mrs CConnell said she gave permifi-

sion to her husband to buy the mare, ajid gave him £10 to pay for it. Part of this money might have been for other things.

The Magistrate said the plaintiff's evidence was the more worthy of credence, and an order was madV for return of the mare or payment of £15 claimed as its value, with costs £2 9s.
