MAGISTRATE'S COURT.

(Before Mr T. A. B. Bailey, S.M.) Three first offenders for drunken-, ness were each fined os and costs. DEFAULT CASES. Judgment was given for plaintiff with costs by default in the following cases: —Arthur Cleave and Co.. Ltd. (Mr Rowe) v G. A. Allen, £2; John Phillips v Edward Dransfield, £1 16s 4<l;. Beath and Co. (Mr Taylor) v Thomas Morrif, £1 los; Canterbury Brickmakers' Industrial Union of Workers (Mr Hunter) v T. Fraser, 13s; same v 1' - Leslike, £1 14s 6d; same v H. Eraser, 13s; E. W. Christienson (Mr Johnston) v Annie Smith, £10 12s 2d; W. Strange and Co. (Mr Bain) v Minnie Nolan, £1 lis; F. B. Hughes v F. F. Birdhng, £6 6s 3d. JUDGMENT SUMMONS. James Brown was ordered to pay Albert Russell (Mr Leathern), £20 9s 9d, at the rate of £2 per month, or go to gaol for ono month. CLAIM FOR EXPENSES AND WAGES. Jack Harris (Mr Cassidy) claimed £1 7s 2d from Fanny Bush (Mr Johnston), expenses incurred in travelling to a situation at Amberley and .wages in lieu of a week's notice. The plaintiff, who described himselt as being out of work, said that he was recently engaged by Miss Harrington, a registry office-keeper, to go to defendant's" nlaco at Amberley to groom horses, milk cows, and make himselt generally useful. When ho arrived he war. told that the situation had been Wm. Charlton, also out of work at present, said that Miss Bush had engaged him through Mr Labatt, and when plaintiff arrived he was told tho position was filled. Miss Harrington gave evidence as to being instructed by Miss Bush to procure a suitable farm hand. Sho saw the olaintiff, and • wrote to tho defendant about him. Sho showed Harris tho letter, and later, as sho did not receive a reply, sho suggested that plaintiff should jro to .Amberley and see defendant. This he did, and when ho returned and informed hertho position was filled she returned his fees. The Magistrate, without calling or. the defendant, gave judgment for her. A CARPENTER'S CLAIM. Jas. Lyon (Mr Weston), a carpenter, claimed '£7 7s 7d from James Roxburgh (Mr Hunt) for wages, travelling, expenses, and money leat. The plaintiff, stated that about June, 1908,- fie met tho defendant in the Provincial Hotel at Christchurch, and defendant informed him that he was putting in for a contract for tho erection of a house at Little River. Ho promised plaintiff that if he was successful in securing the contract ho wouid employ him. In October defendant sent for him, and ho worked on the job till December 18th. Plaintiff contended that ho was engaged in Christchurch, and was, therefore, entitled to tho additional 15 per cent, wages allowed under the award. During the time he worked for defendant he lent him 4s 6d to pay the plasterer's train faro to Christchurch. Defendant only paid plaintiff's fare from Littlo River to Christchurch.

The defendant said that he did not engage Lyon in Christchurch. Tho plaintiff wrote to him asking for a job, and he thought ho would give him a turn. He could have obtained plenty of carpenters on tho job if he had cared to do so. He did not pay plaintiff's fare either to or from Little River, and absolutely denied borrowing any money from plaintiff. The Magistrate said he would hold plaintiff was engaged in Christchurch, and would givo judgment for tho amount claimed less! 4s 6d. Ho suspended execution of tho judgment for three weeks in order to allow Mr Hunt to obtain an interpretation of tho award from the Arbitration Court. A TAILOR'S BILL. " TV. J. Sullivan (Mr Rowe) claimed £3 from W. Stewart for clothes supplied. Judgment was given for t'he amount claimed.
