A CHARGE OE PERJURY.

♦ At the Police Court yesterday, before Captain Maroiel, J.P., end Mr J. T. Brioe, J.P., William Baxter was charged with having on Febru* ary 27th, 1905, at Lyttelton, committed perjury by ewearing' that he did serve one Alexander Crose personally with a 6umm6ns' under the Magistrate's Court Act, 1893, at Lyttelton on the 24th day of Februaiy, 1905, such assertion being known to him to be false. William Dryburgh Wallaoc, clerk of the Magistrate's Court at Lyttelton, deposed ■that on 24th February, 1905, the defendant wae given a summons, issued en his account, to serve against Cross for debt. On February 27th he made affidavit before witness that he had server! Cross personally with the summons at Lyttelton on the 24th February. ' Otto Edward Peterson, master of the schooner Eonga, deposed that he left Lyttelton on February 24th for Havelock. Arriving there on the 27th he letters, one addressed to Alexander Cross, care of witness. Cross was a sailor on board the RoUga, and witness handed over the letter to hin>. Crose opened the letter in witness'e presence. Witness saw it contained -a piece of blue paper about the 6ize of a summons form. Alexander Sterling Cross, seaman, stated that the letter in question contained a summons for himself, which had been taken out by Baxter for a debt of £2 odd. Baxter had never personally served a summons on witness for that debt. Acting-Detective Connel 6tated that he arrested Baxter on Monday on the present charge. Witness explained the charge, which accused admitted. Accused, who had nothing to 6ay, was committed for trial at the next session of the Supreme Court. Bail was allowed—accused in £25 and one surety of £25.
