AN ABATTOIRS CASE.
(PRESS ASSOCIATION' Tr.I.F.GIIAM.) INVF.RCARGILL, August 2. Mr Just fee Deiiniston has delivered judgment in the appeal case Invercargill Corporation v. Southland Meat Company, aretailing firm doing business in the town in mrat :upplied from the Frozen Meat Company's works, and inspected by the Government veterinary. The defendant company, by verbal agreement with the Mayor, had'paid ihe Corporation abattoir fees on meat sold, but the Council laler repudiated the arrangement, and refused to accept fees, with the intent to compel the defendant 1o •filaughler at tho abattoirs. They continued to ,-e't and the Corporation took action to stop them. The judgo holds that the. Corporation miut fix and accept 11-?*-. Further, that, section 27 of the Slaughtering Act implies the right to fell and expose fur .*<a!c meat slaughter*, d at a, meat, expoit. company's slaughter house in a district possessing a registered abattoir, subject to liability to pay as toll in the shape of fees a sum jmt larger than will provide that such abattoir shall pay working expenses and 5 per cent on capital costs. The fectinn provided ,'iiilhotity to s.-ll upon terms of paying fees, but not for prohibition until tho fees are paid, and that lihwe fees must be demanded or be capable of being tendered. His Honour thought it very doubtful if a per.-on selling meat from a meat export company's slaughter Infuse could be guilty of an offence miller section 17. The appeal was dismissed with £10 10s costs on the appeal.
