"After careful consideration of the evidence, I am satisfied that Kirkpatrick, at the time he took the money, really believed he would be able to repay it within a few days, and never at any time before it was repaid intended to deprive the owner permanently of it," said Mr. S. L. Paterson, S.M., in the Magistrate's Court to-day in giving a reserved decision in the case in which Jack Raymond Kirkpatrick, aged 33, a pay clerk in the air force, was charged with the theft of £50, the property of the New Zealand Government Air Department. Mr. W. J. King appeared for Kirkpatrick. The information was dismissed.
