THEFT CHARGE DENIED
AIR FORCE PAY OFFICER (0.C.) HAMILTON, Friday. A charge of stealing £50, the property of the Air Force, was preferred against a pay clerk aircraftman, Jack Raymond Fitzpatrick, aged 33 (Mr. King), before Mr. S. L. Paterson, S.M., in Hamilton to-day. Accused denied the charge. Evidence was given' by FlyingOfficer A. J. Smith, an accountant, that accused had admitted removing £10 from each of five pay envelopes. He made this admission before the loss was discovered and had then undertaken to return the money. He had since done so. Detective-Sergeant W. R. Murray produced a statement signed by accused in which he admitted having borrowed the money to meet an urgent domestic need, well knowing that he would be able to return it within four days. He was suddenly transferred and had disclosed that he had taken the money. Mr. King contended that the evidence did not support a charge of common theft as there was no intention to deprive the owner permanently of the money. The magistrate reserved his decision.
