ONEHUNGA CHARGE.
MOTORIST INTOXICATED. COLLISION WITH CYCLIST. An Onehunga solicitor, Martin James Rogers, was sentenced to seven days' imprisonment, this morning when he appeared in the Onehunga Magistrate's Court before Mr. F. H. Levien, S.M., on a charge of being intoxicated in charge of a car on Wednesday, June 26.
Sergeant S. A. Brown said he saw accused at 5.67 p.m. at the police station on the evening in question. Three cyclists were also there. One of them had been hit by defendant's car in Mount Smart Road.
The cyclist, Dudley Vincent, said accused left his correct side of the road and drove towards his wrong side, colliding with his machine and injuring him slightly.
Dr. W. H. Thomas, who examined Rogers at 6.15, said that in his opinion at that time he was in a state of intoxication and unfit to be in charge of a motor vehicle.
Rogers, who was represented by Mr. J. Terry, said that he had three or four drinks in Auckland during the afternoon and then drove to Onehunga, where he met the three cyclists. Swerving to avoid a dog, he collided with one of them. Rogers denied the charge of intoxication.
Dr. E. J. Miller, of Epsom, said that when he examined accused at 7.30 p.m. it was his opinion that he was not intoxicated at that time.
Remarking that he did not believe the story about the do«, Mr. Levien imposed sentence of seven days' imprisonment and cancelled accused's license for 12 months.
