JURY'S AWARD.
DAMAGES FOR CYCLIST.
SUIT AGAINST VAN DRIVER. Finding that defendant was guilty of negligence in failing to etop and that plaintiff wae not guilty of negligence, a jury in the Supreme Court yesterday awarded £247 special end £310 general damages to William Ancel Reynolds, labourer, of St. Helier's (Mr. Jordan), who proceeded against Ronald George Orr, of Auckland, motor driver (Mr. West). They held that nlaintiff did not have the laet opportunity of avoiding the accident. The case arose from a collision in Remuera on February 22, 1938, when plaintiff was. riding a motor cycle. Though the two vehicles did not come into collision, plaintiff alleged that defendant was negligent in causing hie cycle to strike a stationary car and capsize. Hβ suffered a knee injury, and later hie knee cap had to be removed. Both counsel moved for judgment, and Mr. Justice Fair reserved for argument Mr. West's motion for judgment and a non-euit and granted him 14 daye to move for a new trial.
