APPEAL COURT CASE. QUESTION OF LIABILITY. (By Telegraph.—Press Association.) WELLINGTON, Friday. The Court of Appeal reserved its decision in the case of Hunia versus Winstone, Limited. The appeal was from the judgment delivered by Mr. •Justice Fair dismissing an action brought by William Hunia, labourer, of Auckland, against Winstone, Limited. Hunia, an employee of the Texas Oil ( oinpany, Limited, was injured while working in that company's yard by a drum of oil which fell a* a result of the negligence of Winstone's lorry driver in unloading the drum. In an action Liken by Hunia the jury held that at the time of the accident A\ instone's driver was under the direction and control of the Texas Oil t oinpanv as to the manner in which the drums were to be unloaded. They fixed damages in the vicinity of £400. Mr. Justice Fair, in his judgment, decided that, as the lorry driver was under the control of the Texas Oil Company, Winstone's could not be held responsible for his negligence, and dismissed the action.
