ESTATE RESIDUE OF £80,000. DETERMINING NEXT-OF-KIN. i An inquiry is to be made by the registrar of the Supreme Court in Auckland to determine tlie next-of-kin who are entitled to benefit from the residue estate of the late Mrs. Catherine Smith, widow of Captain James Smith, of Auckland. .The case came before Mr. Justice Callau in the Supreme Court yesterday. Mrs. Smith died on August 12, 1933, and her estate was valued at over £120,000. The estimated value of fche residue is about £80,000. Under the will the residue was left to charities in or about Auckland, but the Court of Appeal, and afterwards the Privy Council, held that the bequests were invalid through a defect in the wording. The residue now goes to kinsfolk, and it was stated in the Supreme Court yesterday that there were 4.3 claimants. In the course of yesterday's proceedings the New Zealand Insurance Company, Limited, as executor of the will, was represented by Air. R. McVeagh. Mr. Hubble appeared for the Public Trustee in Wellington as executor of the will of Mrs. Annie McLean, deceased, late of Kiimo, widow; Mr. Roger son appeared for the following next-of-kin, Alexander Gill, of Pukekolie, mercer, Jessie Green, Esther Scott, Nellie Lynch, John Urquhart, Donald Urquhart, Elizabeth Urquhart, Margaret Urquhart and Donald Edwin Campbell; and Mr. Reed for other relatives, Roderick McDonald .Campbell, Catherine Warner and Isabella McGregor. His Honor made an order that the registrar inquire who are the nextrofkin, or persons entitled to benefit "by, through or under" the next-of-kin, and for that purpose have advertisements published in the two daily newspapers in Auckland.
