DEATH OF A MARE.

INTERESTING JUDGMENT.

(By Telegraph.—Press Association.)

DUNEDIN, Monday. A judgment of some importance to the -farming community was given in the Supreme Court by Mr. Justice Kennedy in an appeal by Archibald W. Douglass against a magisterial decision in a case heard at Palmerston, in which damages were awarded William Ritchie for the loss of a mare, alleged to have been injured by a stallion during service, as a consequence of the groom's negligence. ° In upholding the magistrate the judge held it was open to the former to find that there was failure to observe the customary precaution, which constituted negligence.
