CHURCH BELLS NOT WANTED. PETITION TO SUPREME COURT. ' (By Telegraph.—Own Correspondent.) DUNEDIN, Tuesday.
After hearing counsel Mr. Justice Kennedy to-day reserved his decision in respect of a petition asking that the object of 'a trust left by the late Mr. Robert Glendining in favour of Knox Church be changed, so that an organ imigh'ftjbe provided instead of a peal of beUs. Mr. Glendining left £1000 for the Knox Church Deacon's Court to provide a peal of bells for the church. It having been found inconvenient to do so, the Deacons,' Court applied to the Court to approve of a change in the object of the trust, under the Religious, Charitable and Educational Trusts Act, 1908, from a peal of bell's to an organ, Mr. J. C. Stephens appeared for Knox Church Deacons' Court and Mr. C. J. Payne for the, Perpetual Trustees Company, executor of the will of Robert Glendining, and the other beneficiaries. , Mr..» Payne said his clients all consented to the making of an order and approved of what was desired by the petition. The only condition they asked was that the estate should not be put to any expense with regard to the costs. The Deacons' Court had undertaken to pay all the costs.: • . ;- Mr. Stephens said it was impracticable to carry out the trust, as the amount of the fund was inadequate for the purpose. The fund now amounted to £1800. A peal of bells would cost £3206. A new tower' would be necessary and would cost £3000, making the total £6206. '■■.'" . -
Mr.. Stephens "said. he could mention two cases in Dunedin where injunctions might be issued against church, bells at the" present time. There was an' affir davit setting out that the price submitted for an organ was £4500. The trust fund amounted to £1800 and the Deacons' Court "had cash in hand of £1590, making a total of £3390. That left a balance of £1110 to be found. There would be no difficulty in obtaining the balance of the money; ashe did not think it would be questioned,that the Knox Church congregation was the wealthiest in Dunedin. . . ~'■
His Honor, in, reserving 'his decision, asked that counsel for the- petitioners should submit a draft order embodying the undertakings referred to in the petition. . . •,
