APPEAL AGAINST TAXATION.

CHIEF JUSTICE'S DECISION.

WELLINGTON, this day. Judgment has been delivered by Chief Justice Skerrett, allowing the appeal of the Aotea District Maori Land Board against its assessment for land tax for the years 1916 to 1921 in respect of the native freehold hind held by the Tongaviro Timber Company under deed of agreement between the board, representing the natives, and the company. His Honor said the board, if it was to be held liable, must have been constituted trustee for the native owners of the timber lands. The mere receipt by the board of royalties or advances in anticipation of royalties and the distribution of those monies among native owners, was not sufficient to constitute the board trustee of timber lands.
