NEGLIGENT DRIVING.

DUHEBZV TOOTH IBHTEHOED

POINT OF LAW RESERVED

(By Telegraph.—Press Association.) DUNEDIN. this day. Ashley George Faigan, aged 20, was sentenced on charges of manslaughter and negligent driving. A pedestrian was knocked down by accused's motor car and killed.

A point of law was submitted by counsel during the hearing in regard to the culpability of an unlicensed driver, and it was reserved for the Court of Appeal.

Mr. Justice Reed said there was too much reckless driving, and the Court could not pass over cases of individuals who were usually of good character. If it did, then there would be no examples and no deterrent.

Accused was ordered to be detained in a Borstal institution for three months, and disqualified from obtaining a motor license for three years.

The judge added that the sentence was on the second charge. On the first charge sentence was postponed till the question reserved for the Court of Appeal was settled. Its decision would be referred to him, and he would not increase accused's punishment.
