A FARMER'S DECREE.

ORDER TOR ALIMONY.

QUESTION OF SECURITY,

(By Telegraph.—Own Correspondent.)

HAMILTON, this day.

In the ' year 1923 a Piopio fanner, Alfred Newcombe, secured a decree nisi in . divorce against his wife, Margaret Annie Newcombe, on the grounds of mutual separation. On that occasion the wife applied for and secured an order for permanent alimony of £4 a week. An attempt was later made to secure an order compelling the husband to give security for the continued payment of £4 per week after death. This was resisted on the grounds that the husband's estate consisted of farming properties, and that it would considerably hamper his.' operations if he had to give security over these. Several efforts to bind petitioner down in the direction - indicated have failed, and today Mr. N. Johnson, on behalf of the wife, sought an order from the Supreme Court compelling the husband to give the security. Mr. W. Noble (Te Kuiti) strongly opposed such an order being granted, and pointed out that this man had been harassed, for two years over the One : solicitor acting for him in the matter had actually entered into an agreement on petitioner's behalf without the latter's consent, and this agreement Mr. Newcombe later repudiated. Mr. Justice Herdman asked why there was such anxiety to put everybody to so much expense? Was the husband a rich' man t

Mr. Johnson said he had an estate worth £5000 or £0000, mostly consisting of farming property.

Mr. Noble said the man had been continually humbugged, and was' now applying for his "decree absolute. This his Honor granted, without prejudice to the question of maintenance after death, which -wpujd. be finally settled next court.
