TOO MANY COOKS.

SALE THAT DIDN'T COME OFF. Judgment was given to-day by Mr. F. K. Hunt, S.M., in a case in which A. B. Proud, a land agent, sought to recoyer £30 commission for the sale of a property from Robert D. Nash. The circumstances were that Nash owned two or three cottages, and sought to sell one of them, for which purpose he put it in plaintiffs hands. The arrangement was that Nash was ta get £250 clear of all commission, and Proud was to have as commission whatever he could get above that sum. He found a buyer who agreed to pay a deposit of £30, and buy the place at £280. In fact, the buyer did not pay anything, but got into the house without the agent's knowledge, and painted and re-papered it with a view to selling it himself. This he failed to do, a?id he rescinded his agreement to buy without having paid anything. In the circumstances, the magistrate stated that he could not hold that plaintiff was entitled to succeed against defendant for the commission claimed, and gave judgment for defendant, with costs.
