fc VERDICT FOR PLAINTIFF. t ! A reserved decision of the Chief Jus--1 tice was delivered to-day at the Supreme I Court by the Registrar in a claim heard I by him last month, wherein Messrs. I Jensen Bros., of Grey Lynn (Mr. Tom s Oliphant) claimed payment of the sum I of £84 12/ for the carrying out of i painting work on two schools at Oranga - and Kopuarahi out of the funds paid ; into court by the Auckland Education i Board (Mr R. P. Towle), employers of - R. A. McKinstry, contractor, now bank- > nipt. The money was paid into court i by the board to meet claims for liens , under the Wages Protection and Coni tractors Liens Act, 1908, by various 3 claimants, the total amount of which • greatly exceeded the amount paid into . . court. This fund had been attached by the plaintiffs for their wages, and the point to be decided by the court was whether the plaintiffs had in the first place any claim at all upon tho fuiu for wages which in the ordinary coursi ai events should have been paid to then by the contractor himself, and if the] had such a claim whether it should bi given priority over those of the liei holders who had already attached tin fund in respect of their claims. c i His Honor held that the plaintiff hai i- established a valid claim for £75, an. 1 that they were entitled to payment o | this sum, together with costs, out o j the moneys paid into court, and . further, that their claim should com ie first, being prior to the others.
