COWS POISONED.
ACTION AGAINST CROWN. FACTS NOT DISPUTED. (By Telcgranh—Own Correspondent.) HAMILTON, this day. An unusual and important case came before Mr. F. W. Platts, S.M., at the Hamilton Court yesterday, when David Morgan, farmer, of Te Kawa, proceeded against His Majesty the King, for £51, the value of cows allegedly poisoned by rabbit poison laid on his property by one of the Department's employees. Mr. Macassey appeared for plaintiff, and Mr. Gillies for the defence. It appeared that the Department's employee had been instructed to lay phosphorised pollard on the adjoining native land. After certain evidence had been tendered, the defence admitted that tho cows were killed by poison, and that it had been laid on plaintiff's property by the defendant's employee. The question for the Bench to decide, therefore, was whether the Department was responsible for the action of one of its employees. After hearing legal argument, the magistrate reserved his decision.
