WILL PROVISIONS ALTERED.
MORE MONEY FOR WIDOWS
An originating summons under the Family Protection Act, relating to the itill of the late Mitchell Newman Downie, ef Okoroire, was heard by Mr Justice Hoskiug at the Supreme Court yesterday. Mr W. P. Endean appeared for the executors, and Dr. F. Fitchett for the Public Trustee, representing four beneficiaries resident abroad. It was explained that the testator left hits wife a sum of £4 a week for life, chargeable on a certain property. This property, however, he sold before his death, and the wife was therefore left unprovided for. The other beneficiaries resident in Xew Zealand consented to the setting aside of a part of the capital of the. estate sufficient to enable the £1 a week to be paid. Dr. Fitchett said that he was prepared to consent to such an arrangement, and his Honor made an order setting aside a sum of £3000 in approved securities for the purpose named, and exonerating the rest of the estate (about £3000) from any charge for the maintenance of the widow and freeing it for distribution amongst the beneficiaries. In a similar application to vary the will of the late William Barker, of Tame!! . his Honor made an order increasing the allowance made to the widow from £1 to 30/ a week, and granting her a lump sum of £25 in cash. He also ordered that the capital of the estate be not distributed amongst the beneficiaries during the lifetime of the widow.
