- ■■ ■ COUNCIL TAKES ACTION. AGAINST TRAMWAY COMPANY. At a special meeting of the Takapuna Borough Council held last evening to discuss matters in connection with the tram and ferry service, it was decided to instruct the borough solicitor to take such action as was deemed necessary to prevent and obtain penalities against breaches of the conditions under which the company holds its righte in the! borough. j At a previous meeting. Mr 3. R. Reed, K.C., advised that the council had no power to impose any fine, but could claim liquidated damages at the rate of £5 a day. The council had power to make by-laws, but he did not suggest this as a practical means of securing the efficient working of the system, and the .Goyeinor-in-Couneil had the power to impose fines upon the company. A motion to go into committee was then defeated by five votes against four. I FREE HAND TO SOLICITOR. f The borough solicitor (Mr Lowry) then discussed in detail the courses of action open to the Council in preventing breaches of the obligations of the comjpany, at the conclusion of which Mr T. B. Arthur moved, and Mr Creamer seconded, a motion that the borough solicitor be instructed to collect evidence and take the necessary steps to institute proceedings in such a way as he thought fit, and at as early a date as possible. | The resolution was carried. j Arising out of a petition from residents at the back of the Lake, protesting against the recent curtailment of the service, and asking for the restitution of certain trams, Mr A. Fulijames raised the question as to the legality of the procedure of the company in not completing the journey, Ultimately, on the motion of Mr Fulijames, the Mayor and -Messrs Cunningham and Fulijames were constituted °a committee to interview the company in reference to the time-table. •
