(By Telegraph.—Own Correspondent.) HAMILTON", this day. At the Supreme Court criminal sessions, Rupert Victor Anderson was charged with having escaped from legal custody. The evidence showed that while on remand on a charge of theft, the accused escaped from the hospital. Mr. HcDiarmid claimed that the accused was not in legal custody, and moved to quash the indictment. The Judge said it was the first time the question bad arisen in New Zealand, and it would be. better to hear the facts. After evidence had been given counsel conferred, and agreed to a verdict of guilty on the facts. The question as to whether the evidence showed a criminal offence was reserved for the Court of Appeal. Accused was allowed bail in his own recognisance.
