WHICH CAME TO TOWIT, CLAIM BY" OWNER. A sum of £lv in connection wit,* prize, fox terrier, alleged to be wrong", fully taken and detained, were claimed in the Magistrate's Court to-day, before Mr. E. (". Cutten. S.M. The 'plaintiff, Elias Mandich. settler. Auckland (Mr! Buttle I, said that the defendant, laaaa Memlelsson, pawnbroker (Mr. finger) was living at the Waiwera Howl irj April, I'JIT. and plaintiff returned to that place to lind the do; was missini-. Ha liad made various applications to defendant for the d"tg. but without result. As he heard the dog subsequently was bred from, thougii then too youni- ha had refused to take it back. He had been offered .C2O for the dog at Gi3borne Show. He purchased it from tha foreman of the Borough Council at Dargaville for £.). and thought he could produce the receipt. Plaintiff" admitted that defendant had when first seen offered to return tha dog, but did not keep an appointment marie to do so. Defendant, last year when written to by a solicitor on behalf of plaintiff, offered to pay £3 or return, the dog to plaintiff. Defendant said the dog followed him on to the boat when be was returning to Auckland from Waiwera, and had remained in his possession for two years during which time plaintiff could have I obtained the animal easily had he called at defendant's home. The dog was not worth £10. Tbe Magistrate said the case contained unusual features, as although plaintiff claimed the dog to he a valuable one, he did not want it back now while defendant seemed equally diffident whether he had the dog or not. However, the defendant might have taken, steps to restore the dog to its owner once he had ascertained that. He would not make an order for return of the dog. but plaintiff would get judgment for £4, which would be assessed as the value of the dog. Costs amounted to £1 12/.
