Hassell and Campbell and Res. v. Q'Shaughnessv. * Courts unajumDOsiv affirmed the convictions, holding that the evidence admitted under protest was admissab'.e. TIMBER COMPANIES TAXATION. •Judgment was also delivered in. the case of tSttp Ka.u: 1 Timber Co. v. the Commis?ioyp>r of Taxes, and the Tajpo Totara Timber Company v. the same. The Court held mat money expended on the purchase of timber lane;, was expenditure ox capital, and that neither Company was entitled to deduct from its profits as assessed for income tax the value of standing timber cut by them. Conditional leave for appeal wa* granted in each case. WELLINGTON" DOCK CASE. In the case Pitcajthiy v. McLean, an appeal from the decision of Sir Robert Stout "in an action arising out of a subcontract for the supply of shingle, .etc., for the Wellington iio.-k. the Court. dismissed the appeal, upholding the decision of the Lhift .Justice, that the appellant? had no right to damages owing to no shingle having been ordered by respondents. Mr. Justice Williams dissented irom the opinion of Justices Edwards and Chapman. Costs were allowed on the highest scale, and conditional leave for appeal to thj Pnvy Council was granted. i ** ~"
