Mr Justice Chapaaan advised that a statement of the points be placed before him in writing, yesterday counsel presented a statement of the points involved, and upon the Court resuming this morning he intimated that under section 4*6 of the Crimes Act he intended to ask for leave to apply to the Court of Appeal for a new trial on the ground that the verdict of manslaughter was against the weight of evidence.. His Honor said ha, would make a note of the application. . **But I will not aay with what result," he added.
The application for leave to appeal will be considered by his Honor, and his decision will be given later. The contention of Mr. Singer is that the Judge wrongly directed the jury in (1) saying they were entitled, if they found prisoner thought she was *o skilled as to perform the operation alleged without death ensuring, to find her guilty of manslaughter, and not directing them, as requested by counsel for accused, that if the prisoner either knew or ought to have known that the operation was likely to cwuse deStto they would have to return a verdict" of muTder; (2) in directing the juTy that even if they found the prisoner guilty of murder the sen- ' tenee of death would not be carried out. Counsel also submits that the Judge was wrong in admitting in the evidence (1) depositions of prisoner given before the City Coroner, and (2) two letters found fey one A. K. Mular (in the shop 1 previously occupied by the prisoner's hsuband) long after the arrest of the prisoner, and while she and her husband were in custody. THE ACCESSORY CHARGES. THREE ON TRIAL The hearing of the charges preferred against James Edward O'Shaughnessy, Mary Hassell, and Charlotte Campbell, of being accessories after the fact to murder, arising out of the death of Elsie Alexandra Holland, was continued at the Supreme Court yesterday and to-day. Mr. Justice Chapman occupied the Bench; Hon. J. A. Tole, K.C., prosecuted; Mr. W. E. Haekett appeared for Mary Hassell, and Mr. R. A. Singer for O'Shaugbsessy and Charlotto Campbell. Elizabeth Stales repeated the evidence she formerly gave at the Polios Court proosedings respecting some admissions made in the course of a conversation with the two female accused. Campbell said she told "a lot of lies at the inquest, and it didn't take her five minutes to make them up." Hassell remarked: •Don't give the nurse away; she's been good to us." Campbell mentioned that Hassell placed the perchloride of mercury tabloid' ih the mouth of the deceased when she was near the end, to give the impression that the young woman bad poisoned herself. The witness was subjected to lengthy crostvexamination* in regard to her past. sad~Sbe evidence she had given, and denied that the police had threatened to prosecute her for vagrancy. Dr. Milsom stated that he was telephoned for about 2.5 o'clock on the morning of Wednesday, June 14th, by a man, who gave the name of O'Shaughnessy. At the post mortem held on deceased at 1 p.m. on Wednesday he judged by appearances that death bad resulted from 12 to 24 hours earlier. The doctor gave other evidence similar to that in the murder trial.
