TESTERD4T. "(Before Mr. C. C. settle..S.M-i A PLAINTIFF NONSUITED. The hearing of the case In which Frank Newman sued Walter A. Catbro for £99, alleging a breach of agreement, was continued yesterday afternoon. A counter claim of £84 IS/9 was lodged by the defendant. Mr. Kettle said he did not think that it had been proved that the plaintiff and the defendant had agreed on the payment of £75 to the former. The action was brought upon an agreement, and. was not an action for damages for dismissal- He accordingly nonsuited the plaintiff, with costs, allowing the parties a week to - consider the question of the counter-claim. CLAIM AGAINST A MINISTER. A' claim for £4, value of goods alleged to have been detained, and £10 for the detention of the property, was made by 3. H. Pagni (Mr. Neumegen) against Rev. Alexander Mackenzie (Mr. Brookfield). It was stated that the plaintiff bought a farm of £ 1000 from the defendant, and subsequently his offer was accepted for other small implements employed in cultivation of the farm. The present case arose but of a dispute connected with certain implement* which were alleged to have been Included in the purchase. The defendant did hot agree that these articles were the property of the plaintiff, and his Worship reserved his decision.
