YESTERDAY.

(Before Mr C. C. Kettle, S.M.) At thfe S.M. Court yesterday, Alexander Stewart sued James McColl tor' £31 1/, damages for the destruction of a horse, the property of plaintiff. The plaintiff's case was tnat In November he paddocked his horse at Ketuuera, and during the night of November 2Sth defendant's mare kicked it, fracturing the off foreleg, and rendering its destruction necessary. h'ov the defence it was contended that no legal liability was cast upon defendant, whose horse had broken away from the place where ie was tied up Dy his son. liis mare was quiet, aud he did not know how it had got into the paddock. The case was adjourned until Thursday next tor legal argument.

Scbneideniau Bros., tailors, sued Sirs Alfred Nathan for £12 12/, for work done, materials provided, and goods sold and delivered to plaintiff. Mr I. Basley appeared for plaintiffs and Mr E. Russell tor defendant. Isidore Schneideman stated that Mrs Nathan ordered a costume at 10 guineas. The costume was made, and after several alterations desired by defendant had been made, was forwarded to her residence. She had previously stated that the dress was very beautiful and nice. Subsequently he received a letter stating that the dress was lying at defendant's house at their own risk. The case was then adjourned until Wedensday next.

At the S.M. Court to-day orders on judgment summonses were made by Mr C. C. Kettle. S.M., as follow:—G. W. Wright v. E. Marshall. £5 9/. amount to be paid withiu seven days; A. B. Wright and Sons v. Frederick H. Wells, £3 15/, amount to be paid within seven days; J. Martin and Co. v. Charles Crocker, £9 15/6, amount to be paid within seven days.
