On November 18, 1906, Captain James Tait, master of s-s. Timaru, a dredge, set out in her on a voyage from Timaru to ! Oamaru. At Oamaru. on January 10 of this year, he was proceeded against by the Collector of Customs on an informal ion , alleging that he had proceeded on the' voyage "in the steamship Timaru. bein3 a British Home-trade ship, without a full j crew, as provided by the Shipping and Seamen Act, 1903" The magistrate dis- I missed the information then on the ground that the steamship was a dredge hired by the Oamaru Harbour Board j from the Timaru Harbour Board, and her ' sole business was dredging. She did not I carry freight or cargo, and was not a! ship engaged in the home or intercolonial trade, nor a trading ship, unless the fact i of her proceeding to Oamaru without I freight or passengers constituted her j such. At Dunedin yesterday, the appeal of the Collector of Customs was heard. The sections in the Act upon which the ; argument mainly turned were section _ ("Home trade ship means any ship em- j ployed in trading or going between any ports or places in New Zealand") and. I section 54 (which refers to the comple- ' ment of crew necessary for ships engaged I in the Home or intercolonial trade). Af- I ter hearing argument his Honor reserved judgment.
