MiSenrie, ■which has Tegularly been jbnwglit Wore the presiding Justices for some time.past, was again revived iefore Mr. Justice Denniston at the Supreme Conrf yesterday afternoon. The <ase k a ant to declare void a certain deed a' conveyance signed by Catherine Ifcfcnae, formerly of Omaha in favour . (of one .Alexander MtKenzie, her alleged soa.' The plaintiff in the case is the tabaad of Catherine MeKenzie, who djaiic October, 1904, leaving a Trill in «4ich all her property was bequeathed to plaintiff. The conveyance purports So be witnessed by one G. Knaggs and Jfr. McGregor, -who appeared for the plaintiff, placed a Mr. George Knaggs, j&Omaha. in the -witness box. This witess stated he had resided in Omaha for "6. years. There was no other George - Xaggs there, -nor hsd there, beea.to his ■Jtsfflection. He had never -witnessed the : csreya-nee. He knew Catherine Mcfade, also the land referred to in lie conveyance. Mrs. MeKenzie did not • tgn any such domucent. She could not rite. The deceased lady never had a ton named Alexander. Corroborative evidence -was also given by plaintiff. ! The case is. peculiarly involved one, as lie original deed, tvhich is twenty years eld, cannot be foond.
