DUNEDIN POLICE SENSATION.
DUNEDIN, Friday.
Constable Moses, who had been committed for trial on Thursday, was admitted to bail early this evening, but was at once rearrested by Detective Herbert on the charge of having, in January, entered the premises of the D.I.C, and stolen therefrom a piece of cloth, two rugs, etc., of the total value of £9. He will be brought up at the Court tomorrow. ALLEGED ASSAULT ON A CONSTABLE. INVERCARGILL, Friday. A charge against two brothers named Stott of assaulting Constable Holmes when arresting J. A. Stott on a charge of theft oi vegetables commenced today. The prosecution alleged that the constable, who has been some days hi the hospital, was violently resisted and kicked in the abdomen. LAND TRANSFER APPEAL CASE. WELLINGTON, this day. In tlie Appeal Court judgment was : given in the case of the King v. the Registrar-General of Lands, which was argued on the 23rd inst. This is a very important case under the Land Transfer Acts, which had been removed for argument into the Court of Appeal, -which decided that where the certificate of title, in stating the area of land comprised therein, made a large error which the surveyor could have easily detected by a mere inspection of the plan, the Assurance Fund was not liable in damages to make good the losses incurred by the purchaser of £2074 on buying at a price per acre. In this case the Crown, having been the purchaser, the question was really only as between two departments of State, but an important principle was laid down.
