INDUSTRIAL CONCILIATION.
AN IMPORTANT DECISION

DUNEDIN, Friday,
An important point under the Industrial Conciliation aad Arbitration Act came before Mr Justice Pennefather to-day. The matter came on in the form of an application for the issue of a writ of attachment against William Wright, John Calder, and James Walker, for alleged breaches of the award of the Arbitration Court in the recent industrial dispute between the master bakers and the Dunedin Bakers and Pastry-cooks' Union. Mr J. F. M. Fraser appeared for the Union, and the Hon. J. McGregor and Mr Woodhouse for W. Wright and J. Calder. Mr Justice Pennefather said the case must fail on a preliminary objection. The application was .of a- highly penal nature, and it was therefore necessary that the preliminaries should be observed with the greatest care. The" first point to decide was whether the. award was good, and whether tkerc Avas such an association as the Master Bakers' Association. After quoting clauses of the Act as to the definition of "industrial association," he said, in the first place, it must be an aggregate of industrial associations, and in the second place it must. be registered. In this case there was no evidence that the association was an aggregate of a number of unions, and there was certainly clear evidence that it was not registered.. The law being clear on that point, it was not necessary to enter on the second matter. The application was dismissed. •
