A civil case of interest to shipmasters and owners came before Mr Kenny, S.M., lat Wellington on Wednesday last, in which Mueller and Bern sought to recover the sum of £13 10s from Captain Burton, of the biirquentine Jasper. The plaintiffs, for whom Mr Wilford appeared, alleged that they had undertaken to discharge a cargo of 'Maiden Island guano from the defendant's vessel at the rate of Is Gd per ton. They subsequently discovered thatthey were unable to make their contract pay, owing to the cargo being one from Lady Elliott Island —the deposits procured at that place being very much more bulky and lighter in weight than those at Maiden, much more labour beinu' thus required to move a given quantity. They represented this fact to Captahi Burton, who, they stated, promised to increase the payment to the rate of 2s per ton. They, therefore, claimed for an amount equal to the difference between the cost of unloading a certain number of tons at Is Gd and 2s—an mere ment of Gd. There was also an item of 15 for shifting and mooring the ship. After hearing the evidence of the parties, the Magistrate said he was perfectly satislied that the claim had been trumped up, and the plaintiffs- had endeavoured to put the screw on the captain just prior to his vessel's departure, in the hope that thereby something might be gained. Their evidence, moreover, had been of a most unsatisfactory character. Judgment was given for defendant (for whom Mr Richmond appeared); with costs £1 Is.
