ALLEGED EMBEZZLEMENT.
At the Police Court this morning before Messrs E. F. Rich and A. Walsh, J.P.s, a young man named Alfred George Patterson (on remand), was charged that on or about the 9th November, at Auckland, he embezzled lis from Kathleen Martin. Mr G. N. Brassey, for accused, pleaded nob guilty. Mr McAlister conducted the prosecution. Mr McAlister, in opening, stated thab accused waa employed as cab-driver for Mra Martin. On the morning of, the 9th "November he was instructed to ply for hire for the races, and endeavour to get 20s for the day. Accused drove a party to Ellerslie, but did not account for the money, and the cab was returned in a damaged condition by one of the men thab had driven oub with him. Mrs Martin and her husband gave evidence. Messrs Avenell, McLeod, Woolley, Lillewall and Shaw, who were driven in the cab to the races, deposed that they did not pay Patterson a fare. They merely paid 2s each to tho Ellerslie gatekeeper to enter the racecourse. The accuaed in his evidence stated thab the prosecutor owed him money lor wages. He drove the people out for nothing and received no money from them. He could not get an engagement, so he drove his friends oub and gave them a treat. ~ The Bench said the case must be dismissed. There was nob the slightest evidence that Patterson was paid any money. Costs'were nob allowed.
