MAGISTRATE’S COURT.

MOTORIST FAILS TO GIVE WAY. TO AVOID SERIOUS ACCIDENT. Although there was a long civil list set down for hearing in the Ashburton Alagistrate’s Court this morning, all cases were either adjourned or struck out and the sitting was a short one. Air C. R. Orr Walker, S.AL, was on the bench.

Following an accident on February 22, Gerald T. Clarke (Mr L. A. Charles) was charged with having failed to give way to traffic approaching on his right at the intersection of Burnett and William Streets, and pleaded guilty. Constable J. E. R, Myers stated that there was no question of excessive speed. Clarke’s car was capsized and considerably damaged, but the other vehicle escaped serious damage. Air Charles said that his client dul not give way as he was endeavouiing to avoid a more serious accident. The other car was travelling at some speed. He considered that there were occasions when regulations had to he disregarded in the interests of peisonal safety. The Magistrate: This seems to be a case when a man is bound to bieak regulations in an attempt to sax e himself. Clarke was ordered to pay 10s costs. Affiliation Order. An affiliation order was made against Ronald Jackson, defendant being ordered to pay £l2 12s medical and other expenses, 7s 6d a week maintenance (first payment on Alarch 29), and £2 past maintenance.
