CLAIM AND COUNTER CLAIM
TROUBLE OVER A TRACTOR. The Magistrate (Mr E. D. Mosley) this afternoon heard the claim of James E. Rule (Mr W. H. Woods) against J. Freeman for £74 2s Id, balance allegedly due on the purchase of a tractor and for repairs and accessories. Defendant, who conducted his own case, counter-claimed for £IOB 5s 3d, cost of repairs to the tractor, and excess kerosene allegedly used owing to the faulty construction of the tractor. Defendant admitted certain of the claims but in support of his counter-claim stated that the machine would not start for him, {ind was generally unsatisfactory. Plaintiff denied that the construction of the tractor was unsatisfactory. His mechanics had gone out to defendant’s farm and had started it quit© easily. William S. Anderson and Albert Holmes, mechanics in the employ of Rule’s Garage, supported this evidence. Frank Beavan, who had' worked near defendant’s farm, said defendant frequently had trouble with the tractor. Jack Freeman, defendant’s son, also stated that the tractor was unsatisfactory. Defendant’s counter-claim was nonsuited, judgment being given for plaintiff for £74 0s lOd, costs £4 14s,,and witness’s expenses £1 6s.
