The battery was afterwards found in defendant's house by the police. . In evidence plaintiff said Orr subsequently asked him to sign a statement that he was satisfied with the price, and lie refused. Orr locked the door of the room and detained him for some tr Plaintiff denied that he had got rid | of a “dud” car on On-. It was not for that reason that he declined to buv it back at the price paid. If Orr had enough money to go Home, he had enough to pay him. He refuted the suggestion by Mr Sievwright that the case was a “ species of blackmail oi of writing anonymous letters to the members of Orr’s congregation. _ Mr Scott- asked for a non-suit, as he wao unable to secure the attendance of three essential witnesses. Hie case would be proceeded with . y, hen defendant returned to the Dominion. A non-suit was granted.
