A LIBEL ACTION.
NEW TRIAL ARRANGED

WELLINGTON, March 9
The case in which Zealand Times Company claimed ' from the Wellington Publishing Company (the "Dominion") the sum of £3000 fori alleged libel in an article appearing in the. latter paper on December 11, and in which. the jury on Saturday, disagreed, was again mentioned at' th_ Supreme Court to-day. Mr C. P. Skcrrett, K.C., appealing on behalf of the plaintiff company, moved, under Section 154 of the juries Act, for a new trial to be held during the present session of the' Court. Th_ ' date of hearing, he suggested, coui-i be fixed either by his Honour (Mr Justice Hosking) or the Registraf. His Honour -replied that the; '<.!:.- had better be fixed by the Registrar. He (his Honour) was leaving for Cisborne on Thursday, and he _ did no: know whether the Chief Jiistice would be available for the re-hearing. , An order was made for the re-trial to be heard at a date to be fixed by the Registrar, his Honour remarking that' he would- give instructions to have a jury summoned for that date.
