CHRISTCHURCH. Thursday, March 16. {Before Mr R. Beetham, S.M.) Civil Casus. — Tindall v. Maude ancl Harman. Mr Deacon for plaintiff; Mr Russell for defendant. This was a claim for £120 for wages in connection with the development and management of an asbestos mine in Tasmania. Both plain till' and defendants were members of a syndicate wliidli had been j formed for the working of the mine, of which plaintiff was manager. Plaintiff had worked under an agreement dated Dec. 22, 1896, and had received wages until March 525, 1898. He had received one week's formal notice of the termination of his engagement some months after work had been stopped, and now sued for £120, being wages at the rate of £3 per week. The case for the defence was that' the plaintiff had already allocated to liimself various sums amounting to £98 out of the £140 claimed, £65 of this being made up of £1 per week, which he had drawn over and above the salary to which lie was entitled, and, further that out of the £42 remaining, of which £40 was claimed a. expenses, the plaintiff had been unable to substantiate any one item.
