The Court, of .Yppeal delivered jadgment ia Attorney-General v. Bunny. Tlie demurrer was overruled on all points with costs. The first point was the validity of the warrant. It was held that the warrant was a bad one under the 25th clause of the Constitution Act owing to the Superintendent delegating his own constitutional powers to another, which he had no right to do. It was his duty to issue a warrant for every payment. The second point was whether the Court had jurisdiction ai all in the matter, A large number of precedent causes were cited, and the Court ,decided 'tlufc.it had the power. The third poiat raised by Mr Travers was the necessity of a re* lator. The Court held that the introduction of a relator in the present case was unnecessary, and would have been improper. The fourth piiat was, ought the Superintendent's name have been joined with that of the' Provincial Treasurer. The Court ruled that it was not necessary, the cjut'se adopted being the proper one.
