WARDEN'S COURT.-Yesterday.

G. Smith v. Shabrholdbbs op Qcebn op BBAUTr.—Mr Macdonald and Mr Tyler for the plaintiffs, Mr Hesketh and Mr Meyers for the defendants.—George Smith and William Thomas were recalled on behalf of the plaintiff, to rebut certain evidence brought forward on the part of the defendants. This closed the evidence, and Mr Hesketh proceeded to address .the Court on behalf of defendants. Mr Hesketh's speech lasted till past one o'clock, when the Court adjourned for an hour. Mr Macdonald followed for the plaintiff, and continued till five o'clook. His Worship then commenced to give judgment, and as it was obvious fromthefirst few words he uttered that he was going to give judgment for the defendants, Mr Macdonald stood up and said that he took a non-suit.
