Walter SLmes claimed from Orton Gebbie the sum of £44 15/5, before Mr H. W. Bishop, S.M., at the Magistrate's Court this afternoon, the amount being principal and interest of money lent and other sums paid on defendant's account. Plaintiff confessed judgment for the sum of £•'»! 7/6, but denied any agreement to pay interest on £SO, which defendant stated had been borrowed at 7 per cent, in 1909. The Magistrate said it was unreasonable to suppose that plaintiff should lend the money for live years without charging interest, but while giving judgment for the plaintiff he could not allow interest at the rate charged, and would reduce it to 5 per cent., and reckon it due from June 2, 1909.
