RUTS AND TRACKS.
A BREEZY MORNING. Ruts and tracks on suburban roads were discussed at the Magistrate's Court this morning before Mr T. A. B. Bailey, S.M. Edgar N. Johnson, for the Heathcote County Council (Mr P. Wilding) proceeded against Fredk. Whittington (Mr Upham) for driving a vehicle on August 4 on the Opawa Road in ruts formed by another vehicle.' Edgar N. Johnson, the complainant, gave evidence as to his having seen Whitti,ngton on the day in question driving in the ruts, and further evidence was called in regard to the bad state of Opawa Road along from Elisor 's Road near Which the breach was said to have been committed. Fredk. Whittington, defendant, stated that on the occasion in question Johnson had come towards himself and W. R. Leech, who had been driving drays, but at the time Johnson had seen them they had not been travelling in any rut. Other evidence was called, but as the result of it all nothing very definite was arrived at, and at the conclusion Mr Bailey stated that on the evidence he could not convict the defendant. He could quite understand that, tracking did a lot of damage, but at the time of being seen by Johnson defendant did not seem to have been in a rut. His appearance before the court would be a lesson in teaching that tracking was serious. A similar information against W. R. Leech was then dismissed.
