WHEREAS, by an Act of the General Assembly of New Zealand, intituled ' 'The -Water Supply Act, 1908," Section 38, it is Enacted that the Council may, from time to time in manner pi"ovided by "The Counties Act, 1908," Make, Alter, or Repeal By-laws to prescribe the terms and conditions upon which any water-race made by it may be used, and upon which water may be supplied and the rates and charges to be paid for water supplied, and the area of land which shall be liable to such rates and charges, and to provide, if advisable, for a scale of rates and charges differing in any district from those in another, or differing in the several sub-divisions of any district according to circumstances. Now, therefore, the Council of the County of Paparua, in pursuance and under the authority of "The Counties Act, 1908," and "The Water Supply Act, 1908," doth hereby Order and Ordain as follows —-Mint is to say:— 1. In the Construction of this By-law the words and expressions following—that is to say—"Council," "District," and "water-race," shall have the meanings assigned to them respectively by "The Water Supply Act, 1908." 2. The Charges which have heretofore been payable for the supply of water in the water-races, as set forth in the Schedule to the By-laws made by the Council on the Ist day of May, 1913, shall, from and after the date of the coming into force of this By-law, Cease to be Payable. 3. From and after the date of the coming -intd" force of this By-law, the Charges to ■ be paid for the Supply of Water in the various water-race districts within the County of Paparua, and in the sub-divi-sions thereof respectively, .shall be respectively those stated in the Schedule hereto. Such Charges shall be Payable in Advance on the First Day .of JUNE in each year, and shall be for the period ending on the Thirteenth Day of April next ensuing. 4. In estimating the amount of the charge to be paid by each Owner or Occupier in respect of water supplied or, to be supplied, or for the use of water in a water-race, the Council shall determine .-... the area of the land, or such Owner or Occupier which it shall. consider 'io be benefited by such supply of water, and the decision of the Council thereon shall be final, and binding on such Owner or Occupier. - 6. The said "By-laws, made by the Council on the Ist day of May, 1913, are' Hereby REPEALED, but such Repeal shall not affect the past operation of the said Bylaws or the validity of anything done or suffered, r or right acquired,. : or ■ duty of • liability incured thereunder.
