This was a case at the instance of the coheirs of the late Mr Fazikerly, calling on the District Registrar to show cause why he should not issue a certificate of title to them as owners of a parcel land at the corner of Union and Clyde streets. The late Mr Fazakerly many years ago became the owner of sections 7 and 8, block XXXVI, of the City of Dunedin, and the Crown grants described the sections as containing one reod each, and as being bounded on the southern side by the Water- of -Leith. According to the affidavit of Mr J. H. Harris, the course of the river many years ago had changed, and it was now claimed, on behalf of Fazakerly's representatives, that in virtue of the grants they were entitled, not only to the land therein described, but also to the accession which had been formed by the retirement of the river from its original course. The Crown, however, in the year 1866, granted the sections on the opposite side of the river, together with all the shingle-beds in the course of the river, to the Superintendent as reserves for the purposes of re creation, and these reserves have since the Abolition Act become vested in the Corporation of Dunedin.

After some discussion by counsel, The further argument of the case was postponed in order to enable the parties to file affidavits supplying the information required by the Court.
