Otautau Magistrate's Court.

Before S. E. McCarthy, Esq., S.M

Wednesday 4th October, 1905. Robert Ronald, farmer, Nightcaps, proceeded against R. S. Chilton, formerly of Otautau. to recover £26 15s value of dishonoured cheque. Judgment by default was given to tho full amount m favour of plaintiff. A Nightcaps case, for the recovery of £2 3s, was adjourned till next court sitting, Bth November. Joseph Parmenter obtained judgment against George Tennant, jnr., for 6s 6d, value of goods supplied, and costs 7s.

Jdhn Neylon, farmer, Ringway, sought to recover from Donald Mcintosh the sum of £21, for 3 years and 6 months' grazing, at £6 per annum, or, as an alternative, asked for judgment for that amount for use and occupation. Messrs Macalister Bros, appeared for claimant, and Mr Haggitt for defendant.

Plaintiff gave evidence m support of his claim, as did also M. Slattery. Defendant repudiated liability, as no fence existed to protect the property from cattle, and denied that he had ever made any arrangement with the plaintiff for the payment of grazing or rent.

The Magistrate gave judgment for the full amount claimed, together with costs of court. £1 15s, witnesses' expenses £1 9s, and solicitors' fees £ 2 12s, m all £26 16s. A local farmer was summoned by the Truant Inspector for failing to send his children to school, and was fined 5s and costs 7s.

An old man who had made application for an old age pension, was brought up for examination, it having been stated to the authorities that he was possessed of property valued at £416, which would debar him from being entitled to the pension. The old man stated that he had no property, and that a mistake had been made m confounding him with another party of the same. name. The case was adjoarned for further inquiry to be made.
